Terms of sale

1. Seller and scope

These terms of sale apply to any purchase made in the game’s Shop by a consumer, i.e. an individual not acting for professional purposes. They supplement the terms of use. They are available at any time on this page and can be saved or printed. The applicable version is the one in force on the day of your order.

2. What we sell

KITSU sells digital content (virtual items usable in the game) and a subscription granting benefits every month:

• Gem packs: 15 Gems for €0.99; 80 Gems (including 5 bonus) for €4.99; 180 Gems (including 30 bonus) for €9.99; 500 Gems (including 125 bonus) for €24.99; 1,200 Gems (including 450 bonus) for €49.99.
• Starter pack — €4.99, once per account: 1 guaranteed UR card, 1 ×10 multi-summon and 100 Gems.
• Legendary pack — €19.99, once per account: 10 ×10 multi-summons, 500 Gems and 1 LR ticket (1 guaranteed LR card).
• KITSU VIP subscription — €29.99 per month, no commitment: every month 10 ×10 multi-summons, 500 Gems and 1 LR ticket; energy and free summons refill up to 20; VIP badge in the chat.

The content of each offer is described in the Shop and repeated on the payment page. Offers and prices may change at any time; the applicable offer and price are those displayed when you order.

3. Prices

Prices are shown in euros, including all taxes (VAT included). VAT: [À COMPLÉTER : EU VAT number, or “VAT not applicable, art. 293 B CGI”]. There are no delivery costs. Any fees charged by your bank (for example for a payment in another currency) remain your responsibility.

4. Ordering

1. Logged in to your account, you choose an offer in the Shop.
2. You tick the box by which you ask to receive the content immediately and waive your right of withdrawal (see the “Right of withdrawal” section): without it, the purchase is not possible.
3. You are redirected to Stripe’s secure payment page, which summarises the offer, its price including VAT and, for the subscription, its monthly renewal.
4. The contract is concluded when Stripe confirms your payment.

Your purchase history is available in the Shop (“My purchases”). Stripe sends you a receipt by e-mail to the address given during payment.

The Starter pack and the Legendary pack can each be bought only once per account. If a second payment goes through anyway (two open tabs, for example), it is refunded automatically and delivers nothing; the same applies to a second VIP subscription taken out in parallel, which is also cancelled.

5. Payment

Payment is handled by our provider Stripe (Stripe Payments Europe, Ltd.), with the methods offered on its payment page. We never see your card number: it is entered and stored only at Stripe, which is certified under the PCI-DSS security standard. Your bank may require strong authentication (3-D Secure).

The price is payable in full when ordering. For the subscription, the same means of payment is charged automatically every month.

6. Delivery

The content is delivered immediately to your KITSU account, in your “deliveries” to collect in the game, as soon as Stripe confirms the payment (usually within a few seconds). If there is a delay, the server automatically rechecks pending orders for 24 hours. If a paid purchase does not appear, write to us at [À COMPLÉTER : contact e-mail].

7. Right of withdrawal

For a distance purchase, consumers in principle have 14 days to withdraw (article L221-18 of the French Consumer Code). This right does not apply to the supply of digital content not supplied on a tangible medium, where performance has begun with your prior express consent and your express waiver of your right of withdrawal (article L221-28, 13° of the French Consumer Code).

Before each payment, you tick the box: “I want to receive my Gems, my pack or my subscription content right away, and I therefore waive my 14-day right of withdrawal once delivery is made.” Since Gems and packs are delivered upon payment, you can no longer withdraw once delivery is made. The same applies to the monthly content of the VIP subscription (multi-summons, Gems, LR ticket), delivered upon each payment.

The ongoing VIP benefits (larger energy and summon reserves, badge) are a service provided throughout the month. If you wish to withdraw within 14 days of subscribing, write to us at [À COMPLÉTER : contact e-mail] (you can use the form at the end of this page): the subscription is stopped, and you remain liable for the service provided until your request and for the monthly content already delivered, for which you waived withdrawal (article L221-25 of the French Consumer Code).

8. KITSU VIP subscription

• Price and duration: €29.99 including VAT per month, for a one-month period from subscription.
• Renewal: the subscription renews tacitly every month, on the anniversary date, until cancelled, and the price is charged at each renewal. No minimum commitment.
• Content: for each paid month, 10 ×10 multi-summons, 500 Gems and 1 LR ticket; while VIP is active, energy and free summons refill up to 20 instead of 10, and a VIP badge is shown in the chat.
• Simple online cancellation at any time: in the Shop, “Manage my subscription” button, then “Cancel subscription” on Stripe’s secure page, and confirmation. You can also ask us to cancel at [À COMPLÉTER : contact e-mail]. Stripe’s page shows the date on which cancellation takes effect.
• Effect: cancellation takes effect at the end of the monthly period already paid. You keep your VIP benefits until then (with a 24-hour margin), after which nothing more is charged. The current month is not refunded pro rata, except where the law gives you such a right.
• Failed payment: if a renewal is declined, Stripe retries the charge; benefits stop at the end of the paid period and the subscription ends if the payment does not go through.
• Price change: any increase is announced at least 30 days before it applies; you can cancel free of charge before that date.

9. Refunds, duplicates and disputes

Subject to the right of withdrawal and the legal guarantee of conformity, a delivered purchase is not refundable, unless we made a mistake. The duplicate payments described in the “Ordering” section are refunded automatically.

If a payment is refunded, or disputed with your bank (chargeback), the corresponding virtual items are taken back automatically:

• the Gems of the purchase, plus 50 Gems per ×10 multi-summon included (its in-game value);
• the LR ticket, if it has not been used yet;
• for a VIP month, VIP benefits stop immediately.

Cards already obtained are kept. If the Gems taken back have already been spent, your balance becomes negative: no Gems can be spent until your next in-game earnings have covered it.

Before disputing a payment with your bank, write to us: most problems are solved quickly. An abusive dispute (when the content was delivered) may lead to a sanction under the terms of use.

10. Gems and virtual items

Gems (◆) are the game’s virtual currency. They are obtained by playing or by buying them. They are used in particular for summons (5 ◆ per summon, 50 ◆ per ×10 multi-summon) and for purchases from other players on the market.

Gems and all virtual items have no real monetary value: they cannot be converted into money, exchanged for money or transferred outside the game, and they are not electronic money. Cards cannot be resold for real money; the in-game market works only with Gems. They remain usable as long as your account and the game exist.

11. Summons and drop rates

Summons give cards at random. Each card is drawn independently, according to the rates below (per card); no minimum rarity is guaranteed unless stated otherwise.

• Banner summon: for an SSR, UR or LR card, there is a 50% chance that it is one of the banner’s featured cards (EX exclusives included); otherwise, a card of the same rarity among all the game’s cards.
• Exclusive (EX) cards can only be obtained from their banner.
• LR ticket: a single-card summon, guaranteed LR, on the chosen banner (50% chance of the banner’s LR, otherwise another LR of the game).
• Starter pack: the guaranteed UR card is drawn among the URs of the current banners, preferably one you do not own yet.

The current rates are also displayed in the game before each summon. They may change for future summons; a change never affects a summon already made.

12. Legal guarantee of conformity

We must supply digital content that conforms to the contract (articles L224-25-1 et seq. of the French Consumer Code).

13. Personal data

The data needed for your purchases is processed as described in the privacy policy. Your banking data is processed by Stripe alone.

14. Complaints and mediation

For any complaint, first write to us at [À COMPLÉTER : contact e-mail] or by post to [À COMPLÉTER : postal address].

If no solution is found, you may use, free of charge, the consumer mediator we belong to (articles L612-1 et seq. of the French Consumer Code): [À COMPLÉTER : consumer mediator (name, address, website)]. The mediator can only be contacted after a written complaint to us, and within one year of it.

15. Governing law

These terms of sale are governed by French law, without depriving you of the protection of the mandatory rules of your country of residence if you are a consumer in the European Union. Disputes are brought before the competent courts; as a consumer, you may bring proceedings before the court of your place of residence.

16. Withdrawal form

Only fill in this form if you wish to withdraw in the cases where this right exists (see the “Right of withdrawal” section), and send it to [À COMPLÉTER : contact e-mail] or [À COMPLÉTER : postal address]:
