1. Purpose and acceptance
KITSU is an anime-themed collectible card game, free to play in the browser, published by [À COMPLÉTER : publisher’s full name or company name] (“we”), whose details appear in the legal notice.
These terms of use apply to anyone who visits the website or plays (“you”). Purchases are also governed by the terms of sale, and the use of your data is explained in the privacy policy. By logging in to the game, you accept these terms.
2. The service
KITSU lets you, among other things, obtain cards through random summons, level them up, play the Adventure, fight other players in the arena and in tournaments, trade cards, use the player market, join a guild, chat (chat, private messages, voice chat during arena battles) and receive notifications.
The game is free. Optional purchases are offered in the Shop. You need a recent browser and an internet connection, at your own cost.
3. Account and Discord login
You can only log in with a Discord account: you therefore need one and must comply with Discord’s terms. We never receive your Discord password or e-mail address (see the privacy policy).
- Your KITSU account is personal. You must not sell, lend or transfer it, nor use someone else’s account.
- A session stays open in the browser until you log out: log out on a shared device. You are responsible for what is done from your account.
- Your username is initially your Discord name; you can change it. It must not be offensive or misleading (impersonating a team member or another player) and must not contain other people’s personal data.
- Creating several accounts to obtain referral rewards or to get around a sanction is forbidden.
4. Minimum age and minors
You must be at least 13 years old, and the minimum age required by Discord in your country, to create an account.
If you are under 18, you need the consent of your parents (or legal guardian) to play, and any purchase requires their prior authorisation. The holder of the means of payment remains responsible for the payments made. If you are under 15, only enable notifications with your parents’ consent.
A parent may write to us at [À COMPLÉTER : contact e-mail] with any question, or to request deletion of their child’s account. If we learn that an account belongs to a child under 13, we may delete it.
5. Code of conduct
KITSU must remain a pleasant place for everyone. In particular, it is forbidden:
- to harass, threaten, insult or humiliate other players;
- to make hateful, racist, sexist, homophobic or discriminatory remarks, or to glorify crimes or terrorism;
- to post pornographic or violent content, and in particular any content sexualising minors;
- to post other people’s personal information (address, phone number, photos…), or to impersonate a person or the team;
- to spam, advertise, scam or phish, or to ask someone for their Discord credentials or session token;
- to buy, sell or trade accounts, cards, Gems or other game items for real money or outside the game;
- to disrupt the service, attack its servers or try to access data not intended for you;
- to exploit a bug to your advantage instead of reporting it to us.
6. Chat, messages and player content
You can publish content: global and guild chat messages, private messages, username, bio, avatar, guild name and logo. You remain its author and are responsible for it. You grant us, free of charge and for as long as it is displayed, the non-exclusive right to store, display and transmit it to other players, for the sole purpose of running the game.
- Global chat messages and your public profile are visible to all players. The global chat keeps the last 2,000 messages of each room; older ones are deleted automatically.
- Private messages are only visible to their recipient. We do not read them, except following a report, for security needs or a legal obligation.
- The “Translate” button and the chat’s automatic translation send the text of messages to our translation provider DeepL.
- Voice chat only exists during a live arena battle, and only during your turn. Sound travels directly from one browser to the other (peer-to-peer): it does not go through our servers and is not recorded by us. This type of connection reveals your IP address to your opponent’s browser. Do not record other players without their consent.
We may remove, without notice, any content that breaks the law or these terms, and every player can delete their own messages. To report content, see the legal notice.
7. Trades, market and virtual items
Players can trade cards (1 to 3 on each side, of the same rarities; an offer expires after 72 hours) and sell cards on the market for Gems (48-hour listing; a 10% tax is deducted from the sale price). An accepted trade or purchase is final: we only intervene in disputes between players in cases of fraud or bugs.
Cards, Gems, tickets, cosmetic items and other game elements are virtual items: you have a personal right to use them in the game, not a property right. They have no monetary value, are not refundable (except in the cases provided for by the terms of sale or by law) and cannot be resold for real money or traded outside the game.
To keep the game alive, we may change its balance: card stats, rewards, prices in Gems, time-limited events and banners. The current drop rates are always published before a summon.
8. Cheating, bots and automation
The following are forbidden: bots, scripts, macros, auto-clickers and modified clients, automated play without a human, exploiting loopholes, and using several accounts to gain advantages (especially referral rewards).
To ensure fairness, the server itself checks every battle and every gain. It also detects signs of automated play: simulated clicks rejected by the browser, battles finished faster than a human can, activity without breaks for very long periods. In that case, the game may ask you to tick an “I am not a robot” box (possibly provided by Cloudflare Turnstile) before you can keep fighting. Referrals are also checked (age of Discord accounts, IP addresses protected by hashing).
These automatic checks can only temporarily block certain actions until verification: no final sanction is ever taken solely automatically.
9. Sanctions and bans
If you do not comply with these terms, we may, depending on the seriousness and repetition of the facts: warn you, delete your content, restrict access to the chat or certain features, remove items obtained illegitimately (cheating, bug, referral or payment fraud), temporarily suspend your account, or close it permanently (ban).
The sanction is proportionate. Except in emergencies or where the law requires otherwise, we tell you the reason, and you can challenge it by writing to [À COMPLÉTER : contact e-mail]. In the event of a ban for a serious breach (cheating, fraud, abusive chargeback, illegal content), the account’s virtual items are lost, without prejudice to your statutory rights.
10. Intellectual property
KITSU is a fan project, not affiliated with the authors, publishers, studios or licence holders of the works it features, and not endorsed by them. Characters, names and artwork belong to their respective rights holders; they are removed upon a justified request (see the legal notice).
KITSU’s own code, logo, visual identity and texts are protected: you may not copy or reuse them without our consent. You may share screenshots and videos of your games for personal purposes.
11. Availability and liability
We do our best to keep the game available at all times, but cannot guarantee it: maintenance, updates, outages of the hosting provider or third-party services (Discord, Stripe…) may interrupt it. We may, without being obliged to, offer in-game compensation after an incident.
We are not liable for indirect damage, nor for problems caused by your equipment, your connection or a third party. Nothing in these terms limits our liability for gross negligence or wilful misconduct, nor the rights the law grants consumers (in particular the legal guarantee of conformity described in the terms of sale).
12. Changes to the game and the terms
The game evolves: content, features and rules may change. We may also amend these terms; for any significant change, we will notify you in the game a reasonable time before it takes effect. If you refuse the new terms, you can stop playing and ask for your account to be deleted. A change in the subscription price follows the rules of the terms of sale.
13. Account deletion and end of the service
You can stop playing at any time. To delete your account and your data, write to us at [À COMPLÉTER : contact e-mail] (there is no in-game button yet); we may ask you to confirm the request from the account concerned. Deletion is final: collection, Gems and purchased items are lost. Remember to cancel your VIP subscription first; otherwise, we will cancel it.
We may close an account in the cases set out in the “Sanctions” section. If we had to shut the game down permanently, we would notify you at least 30 days in advance and the VIP subscription would no longer be charged.
14. Governing law and disputes
These terms are governed by French law. If you are a consumer living in another country of the European Union, you keep the protection of the mandatory rules of your country.
In case of difficulty, first write to us at [À COMPLÉTER : contact e-mail]: we will look for an amicable solution. You can also use a consumer mediator free of charge (see the terms of sale). Failing that, the dispute will be brought before the competent courts; as a consumer, you may bring proceedings before the court of your place of residence.
